يحل مضوع الملامة لتجارية أهمية كبيرة في المجال الاقتصادي والتجاري في وت لها وظيفئيا المعنوية اتيز بضائع تاجر عن غيره من التجار، وبذات الوقت يعر حقا ماليا يجوز التصرف فيه والإتقاله لشخص أخر غير مالكه، سواء لبتعمالا، أو لتغلالا، أو تصرفا، من حلار إيرام العقود لعطة كأرهن، و البيع، ولنحيم بالإتعرال.

تناول عد الترغيس بلإتعل الملامة لتهارية من جميع جواليه، مما يعتبر عد التر خيم باستعمال العلامة التجارية وسيئة تمكن المرخص له من لتعدل علامة لمرخص رفق لشروط لتجارية، وشروطها، وماهية عقد الترحيص بأستعمل العلامة التجارية، وأثره، وتبيلن مدى معالجة القوالين النافذة، ولتومل إل أقتل ممالجة، وفي نياية درات أوهيت بإصافة لصوص واضعة ومريعة لقائون العلامات التجارية الأردن، تتظم العلامة التجارية، وكل ما ينشأ عنها، وتنظيم ملحق خاص يبين التزلمات المرخص والمرخص له وواجيائهم.

الملخص الإنجليزي

The construction contract (FIDIC 99) has a great importance in the construction sector internationally as it is a model contract adopted by many construction projects in different countries, and therefore the problem of this research is that this model contract is used in different legislative environments without finding the extent to which the terms of the variation orders are compatible with the rules Judgment and public policy in every legislative environment in which it is used, as well as comparative legislation, as through international studies, it was found that the volume of disputes resulting from these orders occupies the first ranks in their proportion, so this research aims to study the legal nature of these variation orders in various legislation And compare them, here lies the importance of the research to show the compatibility of these conditions with the provisions of the regulating laws in the various legislative evidence, and this research followed the analytical and comparative approach, where the basic concepts associated with the study were discussed, and the comparison with the Jordanian civil law was made as a basis for the study and the various legislations.

The research reached a set of results, the most important of which is that the acceptance of the basic contract does not provide the employer with the right to obligate the contractor to implement the new work resulting from the variation order without the acceptance of the new work in accordance with the Jordanian civil law, and its provisions are derived from the contracting contract in Islamic jurisprudence, on the contrary, from the Latin school and English law, as well as the subject of the work represented in the unrealized work in some types of variation orders in addition to the price in the event that the contractor offered price and did not agree to it, and the most important recommendations made by this research is to reconsider the terms of the variation orders contained in the Construction contract (FIDIC 99) by the regulating legislation in each country adaptation of these conditions in line with the regulating laws.
