ساهمت الثورة التكنولوجية في تطوير تقنيات حديثة ومتطورة في محال الاتصالات، على الرغم من إيجابياتها المتعددة.
إلا أن البعض يستعملها في نطاق سلبي كاستعمالها كوسيلة لارتكاب الجرائم، وباعتبار اتصالات الأفراد تدخل في إطار السرية ما يجعلها تتسم بالخصوصية فقد ضمنها القانون بنوع من الحماية الخاصة؛ غير أن ضرورة التحري والكشف عن الجرائم تقتضي اللجوء إلى مراقبة هذه الاتصالات، هنا تثار مسألة الموازنة بين الحق في خصوصية الاتصالات الشخصية ومسألة تحقيق العدالة الجنائية.
بعد مناقشة أهم المسائل المتعلقة بنقاط الموضوع تم التوصل أن مسألة الموازنة تتمثل في ضوابط المراقبة الإلكترونية والتي تعد كضمانات قانونية لحرمة الاتصالات الشخصية.

The technological revolution has contributed to the development of modern and advanced technologies in communications, despite its many advantages.
however, some people use them in a negative way, such as using them as a means of committing crimes, and considering that individuals’ communications fall within the framework of confidentiality, which makes them characterized by privacy, the law guaranteed them a kind of special protection; however, the necessity of investigating and detecting crimes requires resorting to monitoring these communications, here the issue of balancing the right to privacy of personal communications and the issue of achieving criminal justice is raised.
they are legal guarantees of the inviolability of personal communications.
الملخص FRE
La révolution technologique a contribué au développement des technologies modernes et avancées dans les communications, malgré ses nombreux avantages.
cependant, certaines personnes les utilisent de manière négative, comme les utiliser comme moyen de commettre des crimes, et considérant que les communications des individus tombent dans le cadre de la confidentialité, qui les caractérise par l'intimité, la loi leur garantissait une sorte de protection spéciale; cependant, la nécessité d'enquêter et de détecter les crimes nécessite de recourir à la surveillance de ces communications, ici se pose la question de l'équilibre entre le droit à la confidentialité des communications personnelles et la question de la réalisation de la justice pénale.
ce sont des garanties juridiques de l'inviolabilité des communications personnelles.
