تعتبر السلطة العليا للشفافية والوقاية من الفساد ومكافحته آلية مؤسساتية مستحدثة بموجب التعديل الدستوري لعام 2020 كهيئة رقابية مستقلة، رصد لها نظام قانوني مميز يسمح لها بالتصدي لظاهرة الفساد من خلال منحها صلاحية وضع استراتيجية وطنية تتضمن تدابير وقائية شاملة، مع تمتعها بصلاحية رقابة مدى تنفيذ توصياتها التي تكون متبوعة بأوامر، وكذا إمكانية إحالتها الوقائع الجزائية إلى القضاء.

لكن رغم ذلك تعد الامتيازات المعهودة إلى السلطة العليا مبتورة الفعالية بحكم نسبية استقلاليتها، وعدم تمتعها بضمانات فعالة تكفل لها تتبع مدى إعمال تدابيرها.

The high authority for transparency, prevention and fight against corruption is considered a new institutional mechanism created under the 2020 constitutional revision, as an independent control body.

It is subject to a separate legal system that enables it to fight against the phenomenon of corruption by giving it the power to develop a strategy that includes comprehensive preventive measures at the national level.

It also has the power to control the implementation of its recommendations, by issuing execution orders, as well as the possibility of referring criminal cases to the judiciary.

But despite these prerogatives attributed to this high authority, it is unable to enforce the measures and recommendations that are taken, following several shortcomings, in particular the degree of its independence and the lack of effective guarantees.

الملخص FRE

La haute autorité de transparence, de prévention et de lutte contre la corruption est considérée comme un nouveau mécanisme institutionnel, créé en vertu de la révision constitutionnelle de 2020, en tant qu'organe de contrôle indépendant.

Elle est soumise à un régime juridique distinct qui lui permet de lutter contre le phénomène de la corruption, en lui donnant le pouvoir d'élaborer une stratégie qui comprend des mesures préventives globales au niveau national.

Elle jouit aussi du pouvoir de contrôle sur la mise en œuvre de ses recommandations, en élaborant des ordres d’exécutions, ainsi que la possibilité de saisir la justice des affaires pénales.

Mais malgré ses prérogatives, elle est dans l’incapacité de faire appliquer les mesures et les recommandations qui sont prises, à cause de plusieurs carences dont le degré de son indépendance et le manque de garanties effectives.
