تستهدف هذه الدراسة الوقوف عند أهمية الضمانات التي كرسها المشرع الانتخابي في الأمر رقم 21-01 المتضمن القانون العضوي المتعلق بالانتخابات، لاسيما تلك الخاصة بنزاهة وشفافية العملية الانتخابية من خلال تدخل الأطراف الفاعلة فيها من ناخبين وأحزاب سياسية.

وقد أراد المشرع من خلال الأمر أعلاه تفادي النقائص التي عرفتها العملية الانتخابية في ظل قوانين الانتخاب السابقة، وذلك بالنص على العديد من الضمانات بغية تحقيق نزاهة وشفافية الانتخابات في جميع مراحلها، بداية من التسجيل في القوائم الانتخابية، عملية الانتخاب وفرز الأصوات إلى غاية الإعلان عن النتائج والطعن فيها، بما يضمن ممارسة حقيقة للديمقراطية وتجسيد فعلي لدولة القانون.

الملخص EN

The major aim of the study we are dealing with is to take a position on the importance of the guarantee given by the electoral legislator, in ordinance N° 21-01 containing the organic law relating to election stating in particular those related to the integrity and transparency of the electoral process, through the actors intervention who participate deeply in it, in particular voters and political parties by the previous stated ordinance.

The legislator wanted to ovoid the shortcomings that the electoral procrss had known in the light of previous electoral laws, and this by stipulating numerous guarantees in order to achieve the integrity and transparency of the elections in all its stages, beginning with registration in the electoral lists, election process and counting the votes, until the end of announcing the results and contesting them, in way that guarantees a true practice of democracy and an actual embodiment if the rule of law.

الملخص FRE

Cette étude vise à mettre le point sur l’importance des garanties consacrées par le législateur électoral dans l’ordonnance n° 21-01, potant loi organique relative au régime électoral, notamment celles liées à l’intégrité et à la transparence du processus électoral à travers l’intervention des acteurs qui y participent, notamment les électeurs et les partis politiques.

Par l’ordonnance sus-citée, le législateur a voulu éviter les insuffisances que le processus électoral avait connu à la lumière des précédentes lois électorales, et ce en consacrant de nombreuses garanties afin d’atteindre l’intégrité et la transparence à travers toutes ces étapes du processus électoral, à commencer par l’inscription sur les listes électorales, le processus électoral et le dépouillement des votes, jusqu’à la proclamation des résultats et leur contestation, de manière à garantir une véritable pratique de la démocratie et l’incarnation réelle d’un état de droit.
