This research paper started by monitoring the course of the development of the legal framework regulating the elections of members of the House of Representatives, with a focus on the problem that aims to introduce “legal developments framing the elections, whether those that took place on October 7, 2016, or that took place on September 8, 2021, with an indication of the extent of These developments improve the electoral process.

In this context, the most important developments in electoral laws were highlighted, particularly the regulatory law related to the House of Representatives and the regulatory law related to political parties.

This research paper concluded that understanding the legal determinants that frame the electoral process in Morocco requires invoking all the considerations that control the formation of the electoral law, whether political or legal, Hence, the selection of a particular electoral system is not only a technical process, but is mainly related to certain preferences governed by concerns about controlling the political scene on the one hand, and directing the requirements for consolidating democratic practice and electoral justice on the other.

In general, elections in Morocco can only be seen as an expression of the political field, so that they move according to precise rules, which may be implicit at times and sometimes explicit, and related to political bets and goals, aimed at preserving the interests and balances of power within the political field.

This research paper recommended the need to distance the electoral system from hidden and apparent political conflicts and narrow partisan visions inhabited by concerns about the balance of results, and to strive to achieve a kind of stable consensus on this system, as is the case in comparative experiences that succeeded in achieving democratic transition.
