الملخص العربي

تناولت هذه الدراسة أحكام إدارة قضايا الدولة في الدعاوى الحقوقية، من حيث بيان مفهوم كل من الإدارة والوكيل، وشروط تعيينه، والوقوف على صلاحياته وإجراءات تمثيله لدوائر الدولة، وهدفت إلى بيان الجهات المعنوية التي يتولى تمثيلها، وتحديد مدى صلاحيته بتمثيل بعض دوائر الدولة في ضوء عدم وجود نص في القوانين الخاصة، يشير صراحة لصلاحيته في تمثيلها، فضلا عن تحديد الجهة التي يتم اختصامها عند إقامة الدعوى بمواجهة أي من دوائر الدولة، وبيان مدى شمولية تطبيق الشرط الخاص بقبول دعوى منع المطالبة على جميع دوائر الدولة في الدعاوى التي تقام بمواجهتها، وإعفائها من الرسوم والنفقات في الدعاوى التي تكون طرفا فيها، وذلك من خلال استعراض أهم قرارات محكمة التمييز الأردنية، وديوان تفسير القوانين في هذا الصدد وأبرز ما توصلت له هذه الدراسة، أن الوكيل العام يمثل جميع الوزارات والدوائر الحكومية التابعة لها، والمؤسسات الرسمية والعامة في المملكة والقوات المسلحة، والشركات المملوكة لها، واستقرار القضاء الأردني على جواز اختصام دوائر الدولة أو الوكيل العام، وكلاهما إجراء صحيح تنعقد معه الخصومة القضائية، كما توصلت إلى أن إعفاء دوائر الدولة الوارد في نص المادة (12) من قانون إدارة قضايا الدولة، لا يشمل نفقات الدعوى، بحكم أن هذه النفقات لا تؤول لخزينة الدولة، وإنما للأشخاص الذين يقومون بها، فضلا عن عدم شمولية جميع دوائر الدولة بتطبيق الشرط الخاص بقبول دعوى منع المطالبة التي تقام بمواجهتها، بل يقتصر تطبيقه على دوائر الدولة التي تدخل أموالها في خزينة الدولة؛ انسجاما مع الغاية التي أرادها المشرع من هذا الشرط.

وتبين-لنا-ضرورة تعديل بعض النصوص في قانون إدارة قضايا الدولة؛ لتجنب الوقوع في اللبس في تفسير بعض أحكامها.

الملخص الإنجليزي

The provisions of the state cases management in civil lawsuits in terms of clarifying the concept of each of the management and the solicitor, the conditions for his appointment, his powers, and the procedures for his representation on behalf of the state departments.

the study aimed at clarifying the legal entities that he undertakes to represent, and to determine the extent of his competence to represent some state departments, in the light of the absence of a text in the special laws that expressly indicates his competence to represent them.

in addition to determine the party that is litigated when filing a lawsuit against any of the state’s departments, and clarifying the comprehensiveness of applying the particular clause of accepting a lawsuit to prevent a claim to all state departments in the lawsuits that are brought against them, and exempting them from fees and expenses in the lawsuits to which they are a party.

this is done by reviewing the most important decisions of the Jordanian court of cassation and the bureau of law interpretation in this regard, and by indicating the appropriateness of applying the provisions of civil liability to the solicitor of managing the state cases with regard to the damages that befall individuals as a result of his failure to carry out his obligations required by the law.

the most prominent finding of this study is that the solicitor general represents all ministries and government departments affiliated to them, official and public institutions in the kingdom, the armed forces and the companies owned by them, with the exception of those whose private law stipulates that they must be represented by a lawyer appointed for this purpose.

and the stability of the Jordanian judiciary is that it is permissible to litigate the same party or the solicitor general, as both of them are valid procedures with which the judicial litigation takes place.

the study also concluded that the exemption of state departments contained in the text of article (12) of the law of state case management does not include the expenses of the lawsuit, by virtue of the fact that these expenses do not revert to the state treasury, but rather to the persons who paid them, the most prominent example of which is the expenses of expertise and translation.

in addition to not including all state departments in applying the particular clause of accepting the lawsuit to prevent the claim that is filed against them.

rather, this clause’s application is limited to the state departments whose money is transferred to the state treasury in line with the purpose that the legislator wanted through this clause.

in addition to applying the provisions of tort liability to damages arising from the solicitor’s breach of his obligations, and the injured party can refer to the state to claim compensation according to its responsibility for the actions of its subordinate.it became clear to us, the need to amend some texts in the law of state case management to avoid confusion in the interpretation of some of its provisions, and to introduce texts related to the responsibility of each of the state, the solicitor and the lawyers who are contracted to represent it.
