الملخص العربي

تعد حرية الرأي والتعبير حقا أصيلا ومتينا في حقوق الإنسان، وتعد من الحقوق الأساسية في المجتمعات، متيحه للأفراد والجماعات إبداء الرأي والتعبير عن حول القضايا التي تهمه.

وتتكفل الدساتير والتشريعات والمواثيق المحلية والدولية ضمانة حرية الرأي والتعبير في العالم.

هدفت الدراسة إلى التعرف على واقع حرية الرأي والتعبير في الأردن ومدى انسجامها مع المواثيق الدولية.

وتعد هذه الدراسة من الدراسات الوصفية، واستخدمت الباحثة المنهج الوصفي المسحي من خلال أسلوب تحليل المحتوى للنصوص القانونية والتشريعات والتقارير المحلية والدولية التي تعني بحرية الرأي والتعبير خلال فترة الدراسة للتعرف على دلالاتها، ومعرفة واقع حرية الرأي في الأردن.

يتضمن مجتمع الدراسة كافة القوانين والتشريعات والتقارير المحلية المعنية بحرية الرأي بشكل عام وحرية الرأي والتعبير في الأردن بشكل خاص.

وبخصوص العينة فأنه تم اختيار عينة عمدية للتشريعات والأنظمة والتقارير المحلية والدولية الناظمة لحرية الرأي والتعبير مثل الدستور، قانون المطبوعات والنشر، تقارير (مراسلون بلا حدود، مركز حرية الصحفيين، تقرير المركز الوطني لحقوق الإنسان).

خلصت الدراسة إلى أنه في الأردن طرأ على الدستور الأردني ثلاثة عشر تعديلا طال المادة (15)، إلا أن تعديلا واحدا طرأ على البند الخاص في الحريات، حيث اضيف على النص في التعديل عام 2014 كلمة "تكفل" الدولة مرتين، ثم أوجد التشريع الأردني أكثر من (24) قانونا تناولت حرية الرأي والتعبير.

كما بينت نتائج هذه الدراسة أنه وبعد ثمان سنوات على آخر تعديل على المادة (15) وتعدد التشريعات الناظمة لحرية والتعبير، لا يزال ترتيب الأردن في مؤشرات حرية التعبير في التقارير المحلية والدولية في درجات متأخرة ولم تحقق هذه الإجراءات الأسباب الموجبة التي كانت خلف إقرارها، بما يكفل تدفق المعلومات بين الصحفيين والحكومة و / أو بين الصحفيين والأطراف المجتمعية المدنية و / أو المواطنين وأي طرف مما ذكر، كما تبين أن بعض التشريعات تحتاج دمجا أو تعديلا.

وبناء عليه، تقدم هذه الدراسة توصية لتعديل و / أو حذف و / أو إضافة ما يجب في التشريعات والمواثيق الكافلة لحرية الرأي والتعبير في الأردن، بما يعمل على تحقيق الأسباب الموجبة، وما يتوافق مع المعايير والدولية.

الملخص الإنجليزي

Freedom of opinion and expression is an inherent and solid right in human rights, and it is considered one of the basic rights in societies, allowing individuals and groups to express their opinion and express about issues that concern them.

Constitutions, legislation, and local and international charters guarantee freedom of opinion and expression in the world.

In Jordan, there have been thirteen amendments to the Jordanian constitution, extending to Article 15, but one amendment was made to the special clause in freedoms, where the word “guarantee” was added to the text in the 2014 amendment twice.

Then the Jordanian legislation created more than (24) laws.

It dealt with freedom of opinion and expression.

The results of this study show that, eight years after the last amendment to Article (15) and the multiplicity of legislation regulating freedom of expression, Jordan’s ranking in indicators of freedom of expression in local and international reports is still lagging behind, and these procedures did not achieve the compelling reasons behind their approval, to ensure The flow of information between journalists and the government and/or between journalists and civil societal parties and/or citizens and any of the aforementioned parties, and it was found that some legislation needs to be merged or amended.

The importance of the media discourse in politics stems from the merits of many scientific and academic visions and trends of a media or political nature.

Rather, it took a direction that affects social studies as well, which sought to determine the relationship between the ability to influence the media discourse and influence the discourse of political authority, and in another way, determine the basics of logic.

The media and political logic to support the survival of the state and the consolidation of its pillars in order to revise the national identity from any impurity and frame the origins of citizenship to emphasize the nature of rights and duties, and on the other hand knowledge of the controllers and tools in the ideology of the media discourse and its relationship to the process and development of the political system in the Arab countries in general and in Jordan Especially the research sample, and because the media discourse reflects all the tools of political forces and links between the forward-looking communicative philosophies of the fourth power discourse within strategies that emerge in its vision to know the social changes in the sub-forms and individuals intellectually and economically in order to know the extent of the strength of the media discourse in political developments towards sound planning that achieves development goals Comprehensive economic and social knowledge and knowledge of the obstacles to administrative reform on the short or long term.

Accordingly, this study makes a recommendation to amend, delete and/or add what is required in the legislation and laws that guarantee freedom of opinion and expression in Jordan, in order to achieve the compelling reasons, and in line with international standards.
