The inclusion of the environmental dimension in the field of public procurement is of great importance, because reconciling these two aspects is a fundamental necessity.

Public procurement constitutes a means of meeting public needs, but the satisfaction of these needs must not be to the detriment of the environment.

The Algerian legal system did not take into account, following independence, the concern for environmental protection in the regulation of public procurement, but the emphasis was rather placed on the achievement of development in its different dimensions.

The transformation began in 2002 through Presidential Decree No.

02- 250 and then confirmed by Decree No.

15-247 on the public procurement code and public service delegations.

This study aims to demonstrate the manifestations and aspects of the consecration of the environmental dimension as well as the legal mechanisms for environmental protection in the field of public procurement.

L'inclusion de la dimension environnementale dans le domaine des marchés publics revêt une grande importance, car concilier ces deux aspects est une nécessité fondamentale.

Les marchés publics constituent un moyen pour répondre aux besoins publics, mais la satisfaction de ces besoins ne doit pas se faire au détriment de l'environnement.

Le système juridique algérien n’a pas pris en compte, au lendemain de l'indépendance, le souci de protection de l'environnement dans la règlementation des marchés publics, mais l'accent était plutôt mis sur la réalisation du développement dans ses différentes dimensions.

La transformation a commencé en 2002 par le biais du décret présidentiel n° 02-250, puis confirmée par le décret n° 15-247 portant code des marchés publics et des délégations de service public.

Cette étude vise à démontrer les manifestations et les aspects de la consécration de la dimension environnementale ainsi que les mécanismes juridiques de protection de l'environnement dans le domaine de la commande publique.
