الملخص AR

يشكل هذا المقال مساهمة استكشافية تهدف إلى توضيح تمفصل ممارسة قانون الطلاق وتأثيراته على الأدوار الوالدية بعد الانفصال.

هدفنا هو تقديم تقرير عن الطريقة التي يتم بها تناول الأبوة والأمومة ومفهوم "مصلحة الطفل" في قانون الأسرة الجزائري وفي تطبيقاته على أرض الواقع، وهذا من خلال دراسة للأحكام التي صدرت عن محكمة في ولاية عين تموشنت.

يذكر قانون الأسرة والأحكام الصادرة عن المحكمة كلمة "مصالح الطفل الفضلى" لعدة مرات.

ومع ذلك، نلاحظ أن الوالدية (أي الأبوة والأمومة) بعد الطلاق، لا يتم تصورها إلا بطريقة متجانسة وببداهة: هكذا تنسب الحضانة عموما إلى الأم، ما لم يكن هناك تنازل من طرفها، ويمنح الأب واجب النفقة وحق الزيارة في عطلات نهاية الأسبوع والعطلات الرسمية.

يمكن القول أن مصلحة الطفل تتعلق بشكل أساسي بالبعد المادي والتربوي للوالدية.

تظهر المهام الوالدية ضمنية وتقع في إطار رؤية يتم تصورها على أنها "طبيعية" لتوزيع أدوار الوالدين.

This article is an initial exploratory contribution that aims to articulate the practice of divorce law and its effects on parenthood beyond separation.

our aim is to report on the way in which parenthood and the interests of the child are understood in the Algerian law of the family and in its practical applications in the field, based on a study of judgements handed down by the court of justice of the Wilaya of Ain Temouchent.

the family law and the rulings mention the child's interests on several occasions.

however, we note that parenthood after divorce seems to be conceived only in a homogeneous manner and a priori: custody is generally awarded to the mother-unless she withdraws-and the father is granted a duty of care and visiting rights at weekends and on public holidays.

the child's interests are essentially concerned with the material and educational aspects of parenthood.

parental duties appear to be implicit and part of a 'natural' vision of the division of parental roles.

الملخص FRE

Cet article est une première contribution, exploratoire, visant à articuler la pratique du droit du divorce et ses effets sur la parentalité au-delà de la séparation.

notre propos est de rendre compte de la manière dont la parentalité et l'intérêt de l'enfant sont appréhendés dans le droit de la famille Algérienne et dans ses applications concrètes, sur le terrain, et ce à partir d'une étude de jugements établis par la cour de justice de la wilaya d'Ain Temouchent.

le droit de la famille et les jugements mentionnent à plusieurs reprises l'intérêt de l'enfant.

on observe cependant que la parentalité au-delà du divorce ne semble se concevoir que de manière homogène et a priori : la garde est généralement attribuée à la mère-à moins d'un désistement-et le père se voit accorder un devoir d'entretien et un droit de visite les weekends et jours fériés.

l'intérêt de l'enfant se rapporterait essentiellement à la dimension matérielle et éducative de la parentalité.

les tâches parentales apparaissent implicites et relevant d'une vision conçue comme «naturelle» de la répartition des rôles parentaux.
