الملخص AR
يشكل القانون في بعده النظري أحد الطروحات الفلسفية لا من أجل التأكيد على الفعل الاجتماعي في حد ذاته فحسب، بل في معرفة خلفية الإطار الأخلاقي و الموضوعي الذي بموجبه تكون ثمة أنساق و أنماط في تأصيل التشريع و العمل بأحكام النصوص تجاه الأفعال.
كما لا يمكننا تحاشي في هذا السياق عدم الاعتناء بفلسفة القانون عن ذلك الشق النظري بدل التطبيقي الذي بدوره مرتبط بالمنهج الذي يساهم في تحليل الأوضاع باختلاف مواضيعها انطلاقا من القانون أو القوانين التي تنحدر من المجتمع وتسهر على تنظيمه من داخله.
إن فلسفة القانون تعد عمل المجتمع القانوني خدمة لرسالة القانون في بعدها التنظيمي و الهيكلي و الأخلاقي و الاجتماعي من أجل إنشاء تقارب لا بين المدارس الفقهية فحسب بل في توحيد الآليات المعمول بها بهدف تطوير المجتمع من روحه و ثقافته و أصالته ...
الأمر الذي يغطي من التناقضات و الثغرات الفنية و التقنية تجاه النص القانوني صوب الواقع المعيشي ما يقرب وجهات النظر في دعم للعلوم القانونية و ترسيخها في المجتمع الواحد.
الملخص EN
From a Theoretical point of view Law forms one of the philosophical thesises aspects not for the sake of the social action itself but also to know the objective and moral from work that crests some methods and systems authentically of legislative and practice of events.
In this moment, we cannot avoid the focus on philosophical Law without theory to be applied because it depends on Law methodology to explain many contests by Law among several Laws.
This Law can be configured by the society in order to be developed.
The philosophy Law is the action of society to be developed by it its organization, normative, morally and sociology to unify not by all legally legislation tendencies but by technical methods to society culturally and authentically.
الملخص FRE
Du point de vue théorique, le droit forme l’une des thèses philosophiques non pas pour confirmer le fait social mais pour connaître plutôt le cadre historique et objectif que les systems puissent légiférer par le biais des textes vers les faits.
A cet égard, on ne peut pas désintéresser de la philosophie du droit notamment du côté théorique loin de la pratique qui est d’ailleurs liée à la méthodologie pour analyser les situations à travers leurs sujets à partir du droit (s) qui est issu de la société alors elle veille pour s’organiser par elle-même.
La philosophie du droit est un travail juridique pour servir le message que porte le droit luimême notamment dans sa mission organisationnelle, institutionnelle, morale et sociale non pas pour susciter une approcher entre les différentes écoles juridiques mais pour unifier les moyens afin de développer la société par son âme, sa culture et son authentification .
Cela cache en effet les contradictions et évince les trous notamment d’ordre techniques du texte juridique vers la réalité vécue afin de faire rapprocher les différents points de vue par le fait de ce qui renforcent les sciences juridiques et leur enracinement dans chaque société.
