Medicine has been looking for the detection of the fact of death, but it has only reached to describe its symptoms and its signs.

The death for the doctor is a challenge must be addressed in order to save human life, it may also constitute a hope to save another patient is in need of organ may gets it from a dead donor.

On the other hand, Death is a way to escape from the pain of the patient's disease incurable.

This raises several problematic on the legal, religious and moral level.

In this paper we address this issue by defining the concept of Death and the conditions required for the legality of transplantation
