This research entitled “ Divorce (Talaq) in writing and some of its contemporary forms in the Islamic jurisprudence (Fiqh) ”.

It studies indepth an old issue that had dispute and details in the past.

Hence, divorce has currently appeared in new forms due to the development of life aspects.

The researcher talked about the meaning of divorce (Talaq) ; its conditions; interpreting the concept of writing and its types, the ruling of divorce in writing; discussing & describing divorce in writing as a type, eventually, tracking and discussing two contemporary forms of divorce in writing.

The researcher found that divorce in writing is a metaphor in which divorce does not take place unless it is intentional, and that divorce via mobile phone messages and the internetdoes not take place unless the wife makes sure that the person who sent her the message is her husband, in order to avoid family disintegration and guarantee its happening.

In addition, the researcher found that the simulated divorce does not take place unless the husband has the intention to do such too.
