الملخص الإنجليزي

The study aims to examine the legal system for the public employee strike in the Jordanian law and from a comparative perspective.

It will consider historical development of public employee strike, the provisions relating to this matter in international and national convention, and the extent to which public employee are practicing the right of strike in legal systems subject to this study.

The study concludes that there are many conventions stating for the right of public employee to strike, either expressly or indirecly by talking about their freedom of expressing their opinion.

It also concludes that while strike is now days one of the fundamental rights and freedoms in western countries, most Arab countries ban the strike and sometimes forbidding its practice for the public employee.

This probably because legislator here beliefs that strike is only for workers in private sector, which wrong in the light of the recognition of many international conventions of the right of strike for all people including those in public sector.

The study is recommending all countries part of international covenant concerning economic, culture and social right, including Jordan, to recognize and guarantee the right to strike for public employees through their national legislation, in a way chaining balance between the exercise of the public employee right to strike and to ensure at the same time the functioning of public attitudes regularly and steadily.
