The contractual nature of arbitration before the International Centre for Settlement of Investment Disputes requires agreement of the parties of the dispute to go to it under Article 25 of the Convention of Washington.
Arbitration before the Centre is based on the principle of consensus which characterizes the contractual nature of arbitration, but we see practically through the adjudicated cases by the Centre that it has accepted its jurisdiction even in the no agreement between the parties to go to it.
This does not fit with the basic principles of arbitration system under the terms of the Washington Convention Center founder and represents a change in the nature of arbitration thereof.
الملخص FRE
Le caractère contractuel de l’arbitrage devant le centre international pour le règlement des différends relatifs aux investissements nécessite un accord des parties du différend d’y faire recours selon l’article 25 de la convention de Washington.
L’arbitrage devant le Centre est fondé sur le principe du consensualisme qui caractérise le caractère contractuel de l’arbitrage en somme, mais on remarque, pratiquement, à travers les cas statués par le Centre qu’il a accepté sa compétence même en l’absence d’un accord entre les parties d’y faire recours.
Ceci ne convient pas avec les principes de base du système de l’arbitrage selon les clauses de la convention de Washington fondatrice du Centre, et représente un changement de la nature de l’arbitrage de ce dernier.
