الملخص الإنجليزي

The system of the universe is built on scramble which is inevitable.

War is a reality and social phenomenon, often their effects affect capabilities of peoples including cultural property, and affect the cultural heritage of all humanity, this calls for controls on the conflicting parties to humanize the war by subjected it to binding rules dictated by humanitarian considerations.

In this research the researcher deals with the subject of legal protection of cultural property during armed conflicts in Islamic law and international humanitarian law, stating the nature of cultural property, explaining the general provisions of this protection, with an indication of the adequacy of the protection provided by international conventions on this property, and the efficacy of the means used to provide such protection, and pointing out the extent to which the Palestinian people take advantage of this protection in the maintenance of their heritage, and the lawsuit of the occupation for their crimes in this regard, and highlighting the responsibility of the Zionist occupation for the ongoing destruction of Muslim and Christian worship places and targeting the historical and cultural places, also the researcher seeks to find the possibility of benefiting from Palestine joining to the International Criminal Court, To get findings that include the most prominent findings and recommendations reached by the researcher.
