الملخص الإنجليزي

This research deals with the principle of distinction between combatants and non-combatants in international humanitarian and Islamic Sharia law.

This research was interested in rooting the principle from legitimate and legal sides.

The aim of the research as well as rooting for the principle of the legitimate side is to try to put legal proposals that would strengthen and develop the concept of the principle of distinction in accordance with the rules of international humanitarian law on the basis of the principles and provisions of Islamic Sharia.

The research found that Islamic law consistent with international humanitarian law in the adoption of the principle of distinction between combatants and non-combatants in armed conflicts The research used both of descriptive and comparative approaches through reviewing the provisions and rules of jurisprudence in Islamic law, which related to distinction, as well as through the review and analysis of the legal provisions in this regard in international humanitarian law, and the comparison between them when it is needed.
