الملخص الإنجليزي

This study seeks to identify the protection of the Palestinian prisoners and detainees in the Israeli jails in the Islamic Religion and IHL.

The study shows that Israel as an occupying power doesn't abide by nor respect the four Geneva Conventions towards the Palestinian prisoners and detainees, and so it violates their rights.

The study illustrates the status of the prisoners and detainees in the Islamic Religion and IHL.

It also talks about the lgal and judicial mechanism to protect these prisoners and detainees in the Islamic religion and IHL.

The study concluded to certain results which show that the principles of IHL related to the prisoners' and detainees' protection agree with the rules adopted by Islam.

But the main difference between the IHL and Islamic religion related to the prisoners' and detainees' protection, is that the rules applied in Islam are derived from Koran, Sunnah and Ijtihad.

On the other hand, the rules of the IHL are derived from international agreements , customs and humanitarian principles.
