الملخص الإنجليزي

The Captivity as a human phenomenon is not the result of the recent wars and conflicts.

However, humanity knew it a long time ago.

The prisoner of war during his custody may be exposed to several inhuman practices affecting his life as well as his dignity by the detaining military forces.

These forces can mistreat him by killing, torturing or even enslaving him… etc.

Consequently, it was very necessary to find out a special protective system in which his mental and bodily safety must be taken into consideration.

The protective aspects has been deferred from time to time.

The Islamic Sharia and International humanitarian law had brought much respected principles and higher values concerning the prisoners and detainee, These principles, which boosted the Islamic Sharia to be recognized as the most important and highest religious laws ever known, dealt with the human treatment of the prisoner in a way that Islam sees the prisoner as a human being before being an enemy.
