Because of its high status, whether individually or collectively, discretion in passing jurisprudence judgments has been highly recommended by Islam.

This research addresses an important issue, especially in our modern time, namely, jurisprudence discretion in passing judgments.

Prof.

Omar Al-Ahsqar detects the concept of “Collective Ijtihad”, so the study highlights its legitimacy, importance, and bad need, particularly, in the light of contemporary jurisprudence issues and other developments.

Then the research shows in detail the position of Prof.

Al- Ashqar of collective jurisprudence discretion and the extent of his interest in the rulings or passing judgments.

It also highlights his books to shed more light on his great efforts in this respect.
