Medical sciences have known unprecedented development nowadays.

Despite the advantages of this development, it has been coupled with much negative exploitation that amounted to criminality.

We notice today that the transplantation of human organs has turned the human body into a commodity that is sold and bought for the sake of using organs in some surgeries.

This misuse has become a new specialty of some organized criminal groups, finding in the bodies of the poor a mining site for the rich.

This has prompted many international authorities to criminalize this kind of practice.

It is in this context that the Algerian legislator has updated the crime of human organs trafficking in its penal law.

In this discussion, we have tried to answer the following question: what are the legal controls laid down to criminalize human organs trafficking in Algerian penal legislation? First, we defined the crime of human organs trafficking.

Second, we specified the elements of this crime and the penalties provided for it.

Finally, we examined some special penal provisions on human organs trafficking crimes.
