The ever-increase in crime creates a burden on the court in adjudicating cases in reasonable durations.

Yet, the slowness of criminal procedures becomes the first weak point of the criminal justice, which imposes on contemporary penal legislation, including the Algerian legislation, to search for another alternative means that are easier, simple, and more rapid.

Importantly, among all these means that the Algerian legislature and lot of legislations is looking for is the matter of penal as a basic way to face the problem of court saturation with less dangerous cases.

In addition to that, despite all the debate about that, it has considerable efficient advantages that are worth working in order to achieve balanced justice with regard to both simplification and efficiency.

That is to say, the more complicated and heavier procedures undoubtedly create stagnation and left rigid on the judicial system in the state.
