Over the past three decades, a clear interest in Awqaf is expressed in the Arab-Muslim world both by public and private actors.
This paper attempts to analyze the theoretical and practical bases of this trend.
We will analyze the different policies expressed by the officials to discern the objective conditions for a modern rehabilitation of ‘al ‘awqaf.
The paper discusses the governmental management’s strategies of the waqf in the Arab world with a special emphasis on the post-colonial period.
To delineate its weaknesses, the relationship between ‘al fiqh and the jurisdiction will be made in relief.
In this context, the author believes that a modern usage of ‘al ‘awqaf would only be effective if it happens to revitalize the density of the phenomenon of ‘al waqf at its best: its ability to be an active component in the evolving process of the social regulation.
To meet this challenge, a multidisciplinary research system of the ‘awqaf should be considered as an integral part of the academic research agendas.
الملخص FRE
Depuis les trois dernières décennies, un intérêt manifeste au awqaf s’est exprimé dans le monde arabo-musulman tant par les acteurs publics que privés.
Cet article essaye d’analyser les bases théoriques et pratiques de cette tendance.
Les politiques exprimées par les différents acteurs seront analysées afin de distinguer les conditions objectives d’une réhabilitation moderne du système des awqaf.
L’article expose les stratégies de gestions gouvernementales du waqf au monde arabe en mettant l’accent sur la période postcoloniale.
La relation entre fiqh et juridiction sera mise en reliefs afin de délimiter ses faiblesses.
L’auteur estime qu’un usage moderne des awqaf ne serait efficace que s’il arrive à revivifier la densité du phénomène waqf dans ce qu’il a de meilleur : sa faculté d’être une composante active dans le processus en évolution de la régulation sociale.
Pour réussir ce pari, une recherche multidisciplinaire du système des awqaf doit être prise en considération en tant que partie intégrante des agendas de recherche académiques
