The international court of justice has the ability to take provisory measureswhile disputing any litigation in order to freeze the situation and protect the rights of the litigation parts meanwhile to deliver the final judgment.

The tribunal took its power from the article 41 of the statute, considering that it is the legal source to its competence.

It constitutes also the general frame of these measures, hence the articles 73 till 78 of the internal regulation of the court to give detailed disposals concerning the provisory measures made by the court, in addition to the important role of the jurisprudence in that case
