الملخص العربي

هدفت هذه الدراسة إلى البحث في الآثار القانونية المترتبة على قرار الجمعية العامة رقم (67/19)، و الذي منح فلسطين مركز دولة بصفة مراقب داخل هيئة الأمم المتحدة و ذلك من زاوية أخرى أغفلتها أغلب الدراسات السابقة التي عنيت باستعراض المجالات التي شرعت لدولة فلسطين بعد أن كانت مغلقة أمام الكيان الذي نال صفة الدولة داخل الهيئة المذكورة عام 2012 ؛ و ذلك في بعدين أساسيين : الأول يتناول الآثار القانونية الموازية للامتيازات و المقصود بها الالتزامات، و التي لم تكن قاصرة على المجال الدولي فحسب حيث تمتد إلى المجال الفلسطيني - المحلي كذلك، و ذلك في ظلال علاقة ممتدة لا انفصام فيها بين المجالين.

أما البعد الثاني فهو ما يطرحه واقع علاقة كياني منظمة التحرير الفلسطينية و الدولة ببعضهما البعض، إذ هي علاقة تراكمية ابتدأت منذ اللحظة التي أسست فيها المنظمة، بما حملته من بذور توصيفها القانوني وغايتها، و ما اشتملته وثيقتها التأسيسية المفصحة عن كل ما آل لاحقا في مواجهة مع حدود و شعب و أرض دولة فلسطين.

هذا على الرغم من أن هدف اقامة الدولة الفلسطينية المستقلة لم يتأت إلا من جوهر برنامج سياسي تبنته المنظمة الكيان السابق للدولة والمؤدي نهاية إليها.

تتكون الدراسة من فصلين اثنين، يتناول الأول ظروف نشأة منظمة التحرير الفلسطينية و أهدافها المستقاة بشكل أساسي من مواثيقها و من ثم ما نالته من اعترافات عربية اقليمية فدولية تحديدا من هيئة الأمم المتحدة، و قد تم استعراض مركز المنظمة داخل الهيئة المذكورة منذ ما قبل حصولها على مركز كيان بصفة مراقب و بعد حصولها عليه و التطورات التي طرأت على مركزها داخلها وصولا إلى عام .2012 كما تناول الفصل الأول مركز المنظمة القانوني كشخص من أشخاص القانوني الدولي و الأساس الذي تستمد منه شرعيتها.

أما الفصل الثاني من الدراسة فقد استعرض التطور الجديد الذي طرأ على مركز فلسطين في هيئة الأمم المتحدة و التي باتت تتمتع بموجب القرار المذكور آنفا بمركز الدولة بصفة مراقب و بخصوص هذه الدولة فقد تم البحث في ماهيتها من خلال القرارات الدولية و الوثائق المختلفة للمنظمة نظرا لتباين هذه الدولة من وثيقة إلى أخرى.

كما و تناولت الدراسة مفهوم الدولة بصفة مراقب و الدولة كاملة العضوية و طبيعة الاختلاف بينهما من حيث الحقوق و الامتيازات كما و استعرضت أخيرا الآثار القانونية لقرار الجمعية العامة المذكور على الصعيد الدولي فالمحلي الفلسطيني و أثره كذلك بالنسبة إلى علاقة كياني المنظمة و الدولة

الملخص الإنجليزي

The aim of this Thesis is to discuss the legal implications of the United Nations General Assembly Resolution (67\19), according to which Palestine was granted the observer state status in the United Nations.

This Thesis studies the Resolution from an angle that was overlooked in most previous studies that aimed at examining the fields that were made available to the State of Palestine after such fields were restricted for the entity which later obtained the status of a State inside the United Nations in 2012.

The subject was discussed with focus on two basic aspects, the first aspect studies the legal effects parallel to privileges, which are obligations, and that are not limited to the international level only, but extend to affect the Palestinian-local level, as part of the extended inseparable relationship between the two levels.

The second aspect of the Thesis results from the relation between both entities; The Palestine Liberation Organization (PLO) and the State of Palatine, as it is an accumulative relationship that started since the first moment of establishing the PLO, with all implied legal characterization and purposes, and the concepts included in its announced document of establishment, which later became : borders, people and land of the State of Palestine.

The purpose of establishing the independent state of Palestine was purely derived from the essence of the political program adopted by the PLO : a pre-state entity, eventually leading to the establishment of the State.

The study, which consisted of two chapters, explores in its first chapter the circumstances of the formation of the PLO and its purposes, which were basically obtained from its pacts, and from the obtained regional, Arab, and later international recognitions, specifically the recognition by the United Nations.

The Study also examines the status of the PLO inside the UN, starting from before it was granted an observer state status and after it, in addition to the developments aroused on its position inside the United Nations, up until 2012.

Moreover, the first chapter also debates the legal status of PLO as an international legal body and the basis used to derive its legitimacy.

As for the second chapter of the Study, it provides an overview of the new developments that emerged on the position of Palestine in the United Nations, which, as result of the Resolution, became a state with an observer status.

The essence of this state has been studied through the international decisions and the diverse documents of the PLO; as the view of this State differs from one document to another.

Furthermore, the Study explains the concepts of an observer state status and full member states, and clarifies the difference between them in terms of rights and privileges.

Finally, the study discusses the legal effects of the mentioned General Assembly resolution on the international level then local-Palestinian level, and its effect on the relationship between the PLO and the State of Palestine.
