This research aims at studying the refugees’ situation in the international human rights code.

The refuge phenomenon has been discussed in all of the territorial and the international official meetings, currently.

Indeed, it has become a heavy burden for the international community as it is increasing and spreading so rapidly that it affected the host countries at the political, economical, and demographic level and subsequently resulted in negative impact on the refugees themselves.

The study also aims at analyzing the juridical system according to the rules of the international rights and the treaties established for such a case.

We could mention as an example, the refugees treaty of 1951, and the international human rights treaties.

The reasons that usually incite people to take a safe refuge are mainly the bloody conflicts and the violations against civilians.

We will tackle the legal and the juridical protection of the refugees according to the refugees treaties of 1951, the fourth Geneva treaties of 1949, the first and the second protocols of 1977 for they are the first rules which set up the principles that ban violations against civilians.
