Prevail in the world two systems of Public Service, the closed system is characterized by permanent job, which is considered a profession or the career professional , and the employee be in the status of legal regulatory toward public administration, The other system is an opened system which is characterized by temporary job, and the employee be in a contractual relationship with the public administration.

The Algerian legislator , for objective maintain the balance and the continuation of the public service, has taken in the various laws of the Public Service successive the closed system , but in order to adapt with economic and social changes, and in order to give flexibility to the work of administration , the legislator was used some aspects of the opened system ( the contract in certain cases ) .
