The Respect for national human rights laws and non-violation of the provisions of international human rights conventions is one of the fundamental guarantees for the protection of these rights.

International protection of human rights requires national procedures for the enforcement of treaties at the national level, including compliance with their legislative obligations.

Thus A fundamental principle of international law ; is that international treaties that have been duly concluded are binding on all international parties that have concluded them.

This obligation is based on a general rule of law established m international law: the "contract of the law of contract".

Accordingly, there is a presumption in international law: States that when States express their willingness to abide by international treaties, this is an expression of the free will of these States in accordance with their constitutional requirements.

Consequently.

States can not invoke constitutional rnles and domestic law to justify their failure to fulfill their obligations In mtemational conventions, since domestic law can not provide an excuse for the violation of the State's mtemational contractual obligations, and the wrongful act in internationa law remains illegal even if the internal law of a state decides otherwise, but this does not mean full preference Between international law and domestic law, especially in the era of human rights, where the relationship between the two laws is more articulated and fundamental than ever before.

In order to remove the contradiction and achieve integration and integration between domestic (national) law and international law.

the issue of harmonization of domestic legislation with the international texts and conventions ratified and committed by the state has emerged.

The question of the implementation of treaties m the area of the domestic legal system is a relatively recent issue.

In order to examine the relationship between international treaties, national law and mechanisms for the settlement of signed international agreements, we have prepared this comparative study between mtemational treaties and texts on the criminal justice file on the one hand and Iraqi legislation Including the taking of due process to incorporate the provisions and texts of the conventions to which Iraq is party' in the national legislations and to ensure that all that is contrary thereto are broken.

International objectives.

The importance of this study comes in the light of fundamental changes witnessed by Iraq, including the accession of Iraq to 8 international agreements are essential out of nine human rights conventions and the consequent international obligations, and other international conventions.

The third study focused on Iraq's international commitments to human rights conventions, and the third discussed the compatibility of Iraqi criminal justice legislation with international conventions.
