There is no doubt that the form has a distinct role in the judicial proceedings, The validity of the judicial procedure requires to be done in accordance with the form prescribed by law, in the sense that his validity requires availability of formal requirements set by the law in addition to the objective conditions due to competence of judicial procedure position and causes and when attached to the judicial procedure defect in form that is contrary to the form prescribed by law, and thus governs the invalidity of the judicial procedure for defective formality, and the consequent lack of legal arranged for legal effect, and this is what will be the focus of our study for this research.
