After the formal consecration of the principle of freedom to invest, the Algerian policy of investment knew a considerable evolution since 2001.
This consecration however is followed by several limitations; among them we can quote the condition of environmental protection.
Indeed, the constituent of 2016 dedicates freedom of investment, trade and the right to protect the environment.
For a better evolution, the legislator predicted, in the profile of the national and foreign investors, a series of incentive fiscal measures with the aim of protecting the environment.
The investor benefits therefore, from some exceptional advantages, where his project should preserve the environment in the framework of a sustainable development.
However, this incentive policy still turns out to be ineffective in the sense that the interest for this issue is recent, to which we can add a whole series of complicated procedures which the investor has to deal with.
الملخص FRE
Après la consécration formelle du principe de la liberté d’investir, la politique de l’investissement algérienne a connu une évolution considérable depuis l’année 2001.
Cette consécration est toutefois suivie de plusieurs restrictions parmi lesquelles, on peut citer la condition de la protection de l’environnement.
En effet, le constituant de 2016 consacre la liberté d’investissement, du commerce et du droit à l’environnement.
Pour une meilleure évolution, le législateur a prévu, au profit des investisseurs nationaux et étrangers, une série de mesures fiscales incitatives dans le but de protéger l’environnement.
L’investisseur bénéficie de ce fait, d’avantages dérogatoires dès lors que son projet concours à la préservation de l’environnement dans le cadre du développent durable.
Toutefois, cette politique incitative s’avère encore inefficace en ce sens que l’intérêt pour le sujet est récent, ce à quoi on peut ajouter toute une série de procédures compliquées que l’investisseur doit satisfaire
