the phenomenon of tarry and non-implementation of most of the construction projects has grown up, rife in most public works contracts entered into by the state , resulting in a delay of the wheel age of the country, where this paper discussed the effects of consideration personal to conclude a public works contract stage , as this stage, subject to precise purpose of the action including access to the person who has the available financial and technical ability and good reputation to carry the burdens of this decade, in order to ensure its implementation in a manner achieved by the interest of the desired conclusion , and in an attempt to resolve some of the problems that marred the implementation phase of public works contract in Iraq.
