The emergence of electronic contracts have come about as a result of major shifts in communications and information technology.

They are considered as any other contracts and their unique characteristic resides in the fact they are remotely done by using an electronic medium which is the internet where both the approval and acceptance are expressed by e-mail or through a conversation between the two parties in one setting as it is known with the regular contracts which means that the electronic contracting can happen regardless of the place and time In fact , the choice of time and place where the electronic contract is concluded is of great importance and by choosing the time ,an important matter is determined according to the general rules of contract , so the moment of contracting is the same moment when the acceptance arrives in most cases ,and the place of contracting and the nature agreement between the two parties play a big role in determining the kind of law that must be applied and the kind of competent court to look into the conflicts that arise between the two parties of the electronic contract .
