This study aims to confirm the need for standardization of international practices on independent bank guarantees.

the diversity of legal systems in this respect, between the need of codification of the mentioned rules or not, generated multiple problems, particularly the determination of their legal nature and their effects upon the opposition of a third bank against the guaranty operation.the uniform formulation of the abovementioned rules is one of the available mechanisms, after the fashion of the rules issued by the chamber of commerce of paris; nevertheless, the non-binding nature of these rules could impede the achievement of the purpose for which they were established.
