Environmental crime is a distinct crime in modern legislation and this distinction has caused a real predicament for those legislations due to lack of understanding of the traditional mold of criminalization, 0 especially with regard to the structure of this crime.

So, many people today wonder about the feasibility of environmental criminalization in light of its ineffectiveness due to all the legal problems it encounters on the level of legal, physical or even moral aspects.

Therefore, most legislations, including the Algerian legislator, have abandoned the established principles of criminal jurisprudence because they are ineffective in addressing environmental crime and because administrative law has completely failed to reach that end.

The general trend in criminal jurisprudence is towards the development of an environmental criminal law that is concerned only with the environment.

In this context, our research is a contribution to the identification of the parameters of this law which cannot achieve its goal except by overcoming all those difficulties that face the protection of the environment under traditional concepts.

In spite of all the development of the dynamics of environmental legislation, namely at the level of criminalization, environmental crime still faces many problems and at various levels, which is what we are trying to tackle in this research.
