Scientific experimentation on human beings has always been the subject of all legislative attention, to avoid abuses and ensure respect of human rights.
In contrast with the ethical principles which are universal and immutable, the regulations concerning scientific experimentation on human beings must evolve to solve the new questions raised by the continual progress in the field of research.
In order to respond to this evolution, our country has recently modified and enriched the legislative framework concerning the medical and scientific experimentation of medicines for human use.
Our objectives are to describe the legal evolution in the field of clinical trials in Tunisia, to expose the new regulations in this field and to situate them in relation to the ethical requirements to be respected.
الملخص FRE
L’expérimentation scientifique sur les êtres humains fait l’objet depuis plusieurs années de toutes les attentions législatives et réglementaires pour éviter les dérives et garantir le respect des droits des personnes.Si les principes éthiques sont universels et immuables, les dispositions légales relatives à l’expérimentation scientifique sur les êtres humains se doivent d’être évolutives pour résoudre les nouvelles questions soulevées par les progrès incessants dans le domaine de la recherche.
Ainsi, pour répondre à cette évolutivité, notre pays a récemment modifié et enrichi le corpus législatif relatif à l’expérimentation médicale et scientifique des médicaments à destinée humaine.
Les objectifs de ce travail sont de décrire l’évolution juridique dans le domaine de la réglementation des essais cliniques en Tunisie, d’exposer les nouvelles dispositions légales en la matière, et de situer ces nouvelles dispositions par rapport aux exigences éthiques à respecter dans ce domaine.
