It is acknowledged that any crime, no matter how serious it is, has a motive that pushes the criminal to commit this crime.

Despite the importance of the motive of the crime, its role - in Arab legislations - remained confined to either reducing or toughening the punishment within the limits of the legal text.

While foreign legislation focused on the motive of the crime, namely hate crimes, by developing a special hate crime legislation that defines these crimes as offenses afflicting people or their properties on the basis of religion, color, race or origin.

This research offers an analytical study of hate crime, and in order to examine the aspects of this crime, the research has been divided into two sections.

In the first section, we defined hate crime in terms of its legal form and nature.

Whereas in the second part, we studied the positions of comparative legislations in relation to hate crimes and focused particularly on the US law as it includes special hate crime legislation.

The research ended with a conclusion containing the results and recommendations that we believe may ensure an effective handling of hate crimes.
