Although the natural environment has been exposed to serious and lasting dangers and damages, especially with technical and technological development which has been reflected in the destructive power of various armed conflicts and of weapons that are used or that can be used, international attention has been delayed until the last quarter of the twentieth century.

Therefore, international legal rules protecting the environment during armed conflicts before that date were implicit and not related to the environment per se, and thus, they did not play their role in providing a minimum protection.

Even the explicit protection contained in the Convention on the Prohibition of the Use of Environmental Modification Techniques for military or other hostile purposes of 1976 and the additional protocol to the Geneva Conventions of 1977, and the criminal court system make the application of these rules limited, if not rare.

Thus, the ambiguous conditions relating to the embargo make it a narrow prohibition, making protection ineffective to the desired or desirable level, which necessitates reconsideration and the establishment of clear and precise rules
