Agricultural property in Iraq during the reign of the monarchy had always been a big obstacle in the growth and development of agricultural activity in Iraq, despite the fact that the government had issued several laws including the law of the settlement of land right No.

50 of 1932 followed by the law No.

51 of 1932 and the law of the determinations of the farmers’ duties No.

28 of 1933 and the law of the settlement of land right No.

29 of 1938 and the Law of Selling the Emiri Lands No.

11 of 1940and the law of Development and investment of Pure Emiri lands No.

43 of 1951 and the law No.

36 of 1952.

This bunch of laws had never enhanced the farmers’ situation, on the contrary, feudalists and capitalists managed to register large areas of agricultural and Emiri lands as pure property.

Thus, the majority of the land was owned by a very little a few class of people, the feudalists and the farmers, who represented the majority of the Iraqi society had been deprived from.

Diyala was a good example of that and it is the subject of this study.
