The reasons of exemption vary according the rules on which the liability report is based.

If the injured relies on general rules, liability is not denied unless the case is proved to be an unexpected event, a force majeure, an injured party’s fault or someone’s fault.

However, if the injured relies on rules related to the producer’s liability, the latter is not denied unless it is proved that the producer is not legally responsible, or that the defect did not exist in the product at the time it was put into circulation.

It may also be due to the respect of regulatory and legislative rules or the risks of growth and development.
