The research deals with a methodological issue, Which has intervened in the evolution of the jurisprudence term in comparative studies between Islamic jurisprudence and statutory law in terms of form and construction, so that the term of the two parties in comparison is an important part of the subject of comparative studies in terms of rooting and application.

Comparative studies have had an impact on enriching jurisprudential terms and bringing them closer to the legal terminology.

However, the use of certain terms has raised problems in terms of the use of the legal term in jurisprudential construction, which is the fundamental problem in the research.

The research seeks to explain the terminology of modern jurisprudence and its development in comparative studies and to identify the most important problems that employ legal terminology in the construction of jurisprudence.
