Reference to the articles on contracting methods of public procurements in the 15-247 presidential decree, we find that the latter is adopted radical changes from what prevailed in the presidential decree 10-236 concerning contracting methods.
In addition to the change of the name of the tenders, it has introduced some format to contracting methods the public procurements such as the open tender with requirement for minimum capacity.
In contrast, it cancelled some formats prevailing in the repealed Presidential Decree, such as awarding where the administration is often the buyer and to award the procurement to the bidder who offers the least expensive mode
الملخص FRE
A la lecture des articles du décret présidentiel n° 15-247 sur les modes de passation des marchés publics, ceux-ci ont subi des modifications radicales par rapport à ceux du décret présidentiel n° 10-236 portant les modalités de conclusion du contrat.
En plus, du changement du nom de l’appel d'offres, il a créé certains formats de la passation de du marché public tel que l’appel d’offre ouvert avec une exigence de capacités minimale.
En revanche, il a annulé certains formats qui prévalaient dans le décret présidentiel abrogé, tels que l’adjudication ou l'administration est en position d’acheteur et attribuer le marché au soumissionnaire qui propose le moins disant
