The right of defense is consider a fundamental pillar of the possessing of the Criminal Court justice, which occupies the top of the guarantees without challenged, for it relates to the same human rights, and it has been approved by the monotheistic religions, and confirmed by human rights declarations, and also, inspired the constitutions and laws of procedure of contemporary states.

The right of the accused person is to be assisted by an attorney if necessary and if he/she is in need, it must be met at all stages of the investigation, and in the case of insolvency, the state should bear the attorney's fees, therefore, the attorney should be present for the accused to be attended during the primary investigation of felonies and serious misdemeanors, and be able to review the investigation file before the interrogation, the attorney must, also, be available for a misdemeanor accusations in the same conditions, which to be available before the Criminal Court.
