إن تكريس مبدأ المنافسة الحرة كمبدأ ليبرالي يقوم عليه اقتصاد السوق أدى إلى بروز التجميع الاقتصادي كوسيلة لمواجهة التحديات الاقتصادية مثل : المنافسة الأجنبية للمؤسسات، حيث أصبحت المؤسسات الصغيرة و المتوسطة تلجأ إليه كضرورة حتمية لضمان بقائها في السوق.
بالرغم من المزايا العديدة للتجميع الاقتصادي و فائدته على المؤسسات المتجمعة و الاقتصاد الوطني، إلا أنه قد يؤدي إلى الإضرار بالمنافسة نظرا لتأثر المؤسسات المنافسة بوضعية الهيمنة في السوق.
و من أجل تحقيق التوازن في السوق و ضمان حوكمة المؤسسات يملك مجلس المنافسة سلطة مراقبة التجميعات الاقتصادية كإجراء وقائي لتجنب وضعية الهيمنة التي قد يصعب تجاوزها فيما بعد.
لذلك تثار إشكالية في ورقة هذا البحث حول ما هي اختصاصات مجلس المنافسة بمراقبة التجميعات الاقتصادية ؟ و ما هي حدود صلاحياته في هذا المجال ؟

The market economy is based essentially on the consolidation of the principle of free competition as a liberal principle.
In the face of this principle, economic concentrations have emerged as a means of coping with economic challenges.
This applies to foreign competition from firms, or small and medium- sized ones, which use it in an imperative way to ensure their presence on the market.
Although the many benefits of economic mergers and profits for the benefit of group enterprises and the national economy could, however, be detrimental to competition, given the influence on competing firms as a result of their market dominance.
However, the Conseil de la concurrence, through its control over economic concentrations, is able to achieve a real balance within the market and at the same time ensure the governance of companies, thus prohibiting such domination.
Where will it come from to ask what powers does the Competition Council have in controlling economic concentrations? And what are the limits of its powers in this field?
الملخص FRE
L'économie du marché est basée essentiellement sur la consolidation du principe de la libre concurrence comme principe libéral.
En présence de ce principe, sont apparues des concentrations économiques comme moyen pour faire face aux défis économiques.
Ainsi en est- il de la concurrence étrangère des entreprises, ou des petites et moyennes, lesquelles lui font recours d'une manière impérative afin d'assurer leur présence sur le marché.
Bien que les nombreux avantages des concentrations économiques et des bénéfices au profit des entreprises groupées ainsi qu'à l'économie nationale, elles pourraient, toutefois, porter préjudice à la concurrence, compte tenu de l'influence envers les entreprises concurrentes du fait de leurs domination sur le marché.
Or, le conseil de la concurrence de par son contrôle sur les concentrations économiques est en mesure de réaliser un véritable équilibre au sein du marché et assurer en même temps la gouvernance des entreprises, interdisant ainsi ladite domination.
D'où, il sera question de se demander quelles sont les attributions du conseil de concurrence dans le cadre de son contrôle des concentrations économiques? Et quelles sont les limites de ses attributions dans ce domaine?
