The conflicts which embrace an alien element in the cases of heritage ,legacy, waqf and which the Arabic legislature considered to be related tightly with family issue took them part of the individual affairs, found solutions and that when referring them to the most suitable law through clarifying it due to the application without touching the general order nor the general civilities of the judge's country whom the case is exposed in front of.

The study deals with the concept of every issue and the law that governs them with the specification of its gridle as well as the issues that go beyond the application of the nationality law under the Arabic laws, the judicial thought by the supreme court mainly are dealt with.

Through this study, the researcher pointed that the Arabic project united when opted the nationality as a support referring to the divine law if Islam as a chief source
