Formerly, the marketing of tourism was performed through traditional means (audio, print, and visual).

Today, the marketing of tourism and the provision of tourist programs by tourist companies and their acceptance by the tourist public are carried out through the worldwide web.

This has led to the inability of either of the contracting parties to determine the identity of the other contractor, his place of residence and his nationality, which, in turn, can lead to several legal problems.

Among these problems are those related to the responsibility of tourist companies, the responsibility of their partners among tourism professionals, and the requirement of insurance, which preserves the company’s interests so that it can carry on its work, as well as the rights of tourists in case there are mistakes that might cause physical harms or financial losses to them.

The conflicts of laws in international tourism contracts also raise a major problem regarding the law that must be applied in those contracts, and the resulting objective criteria on the basis of which the court can find out about the desires and aims of the conflicting parties in the field of international tourism contracts, including electronic contracts.
