As long as the incident to which the worker is exposed is outside the workplace, it may constitute a traffic accident.

In this case, the same victim finds himself before the application of two laws: Law 83/13 on occupational accidents and diseases and Law No.

88/31 on compulsory motor insurance System of compensation for damage.

In this research, we will attempt to indicate which law provides the most compensation to the victim, starting with Law 83/13, as long as the victim is a worker.

This law defines the compensation as unjust.

The employee has the right to choose the law to be applied to him.

Compensation the provisions of both laws may be used together to obtain the compensation prescribed in Law 83/13 and supplementary compensation under Law 88/31.

In conclusion, we shall attempt to review the difference and the imbalance in the claim for compensation and make suggestions for more protection of the victim and compensation including damage.
