The principle of equal competition is one of the applications of the principle of equality in general, theFrench administrative judge, appeal to the principle of equality in order to settle a competitive issue in inferring from infringement of the principle of equality by the infringement of competition which has the requirement to give the same chances of departure to all economic operations carrying on economic activity whether public or private.
We must therefore strive to achieve a balance of competitive conditions by taking into account all the factors of differentiation between competing players and by favouring a compensatory approach consisting in balancing the constraints borne by public operators and the advantages they benefit.
Today we observe the application of a principle of equal competition to public operators, which manifests itself in particular through the necessary neutrality of their status (Chapter I), and the equalization of the conditions of competition (Chapter II).
الملخص FRE
Le principe d’égale concurrence est l’une des applications du principe d’égalité en général, le juge administratif Français fait appel au principe d’égalité pour trancher une question d’ordre concurrentiel en déduisant d’une atteinte au principe d’égalité par l’atteinte à la concurrence qui a pour exigence de donner les mêmes chances de départ à tous les opérateurs économiques qu’ils soient publics ou privés.
Il faut donc s’efforcer de rechercher un équilibre des conditions de concurrence en prenant en compte tous les facteurs de différenciation entre les acteurs concurrents et en privilégiant une approche compensatoire consistant à mettre en balance les contraintes supportées par les opérateurs publics, et les avantages dont ils bénéficient.
On observe aujourd’hui l’application d’un principe d’égale concurrence aux opérateurs publics qui se manifeste notamment au travers de la nécessaire neutralité de leur statut (Chapitre I), et de l’égalisation des conditions de concurrence (Chapitre II ).
