Business intelligence is one of the new concepts whose legal recognition is still timid.
Some laws protect it, against infringement of the right of intellectual property, or against the disclosure of confidential information.
As for the Algerian legislator, he didn’t address the protection of ideas and information in the light of business intelligence, but benefited from indirect legal protection, unlike many other comparative laws.
The World Trade Organization, through the TRIPS Agreement, has defined the general conditions for the protection of confidential information.
And required the availability of certain conditions so that the disclosure entails a responsibility, that it’s in civil or criminal qualification.
الملخص FRE
L’intelligence économique est l’un des nouveaux concepts dont la reconnaissance juridique est encore timide.
Certaines législations la protègent, contre l’atteinte au droit de la propriété intellectuelle, ou contre la divulgation d’informations confidentielles.
Quant au législateur algérien, il n'a pas abordé la protection des idées et des informations à la lumière de l'intelligence économique, mais cette dernière a bénéficié d'une protection juridique indirecte, contrairement à beaucoup d'autres législations comparatives.
L’Organisation Mondiale du Commerce, par le biais de l’Accord sur les A.D.P.I.C, a défini les conditions générales de protection des informations non divulguées.
Et requis la disponibilité de certaines conditions afin que la divulgation entraîne une responsabilité, que ce soit dans son cadre civil ou pénal.
