This study addresses inquiry in the effect consequent on overlapping of the two civil liability regimes; namely, inquiry into the cases in which the components, and elements of the contractual liability, and liability for wrongful act, combine in one act, and the consequent emergence of the two problems: combining, and choosing between these regimes.

In light of that it was necessary to look into past theories which talked about: duplication of the two civil liability regimes, or their unification; as the saying that both regimes of civil liability is the same, and no difference exists between them, would not lead in conclusion to the emergence of the two problems: combination and choice in case both liabilities concurred in the same act.

Whereas, the talk about duplication in the two civil liability regimes, or at least confirming the presence of difference between these two regimes; would mean, as a result, the emergence of the two problems: combination and choice in case these two liabilities concurred in the same act; as each regime has its own respective rules, and frames.

In conclusion, the researcher found in the abstract of this study, that the baseline of the two liabilities: contractual and tort (wrongful act) in the Jordanian legislation is the same, which is the violation of a past obligation, whether: the source of such obligation was the wrongful act (in liability for wrongful act), or the contract (in contractual
