The recent development in the enforcement of penalties, which has been linked to the increasing calls for reforms on criminal penalties, and which aimed at respecting the human rights of inmates of penal institutions, has had a clear impact on the humanization of imprisonment.

This impact can take the form of many systems of punitive treatment including the adoption of conjugal visits as in foreign legislation for the inmates of these institutions, although Islamic jurisprudence influenced this kind of visits from the earliest times of Islamic history.

The presence of conjugal visits in many contemporary legislations reflects the inmates’ need for it to be implemented in the light of their social and psychological conditions.

Therefore, the objective of this study is to provide a definition for conjugal visits, demonstrate its generic and specific provisions, and explain the mechanism of its implementation, in addition to analyzing it in the light of legislation and evaluating its usefulness in the contemporary punitive policy.
