The electronic tourism phenomenon is considered one of the most important and most complex concepts that the digital revolution produced.

In fact, it reflects an economic reality that includes varying situations which assume great flexibility in relationships between these modes.

In addition, we find the continuous modernization that characterizes the available means in developing electronic tourism, which makes this type of tourism poses many legal challenges.

These legal challenges relate to the balance of contractual relationships and the problem of handling and processing electronic data that forms the core and main driver of electronic tourism.

This modest contribution attempts to shed light on the reality imposed by this innovative type of tourism practices by embodying scientific approaches between it and established legal concepts, whether in the general rules governing tourism activity in its classical form or in those rules governing electronic trade.

We reveal through this research the extent of the ability of these rules and their effectiveness to suit this reality in its various dimensions and to settle all the problems that the reality of electronic tourism has produced.

We also discuss the necessity of introducing legal principles and mechanisms capable of framing the effects of the digital transformation on tourism activity, by identifying the different patterns in which this phenomenon has been addressed, and extracting the most effective solutions through scrutiny in international covenants and various national legislations.
